Norma Lynch v. New York city case was dismissed because of the fact there was no investigation, no audit, no violations of section 29 U.S.C 206, and 207. Therefore, there supposed to not have enforcement of section 29 U.S.C 216.

 

However, the judge did not apply it to Gayle v. Harry’s Nurses Registry Inc. Although, the judge supposed to clarify consent and audit from the department of labor, but it was misinterpreted.
