Mr. Bernstein and the court should not act as the US Department of Labor. The case “Brock vs. Superior Care” cannot be used as a precedent for the (case #07cv-04672) Gayle vs. Harry’s Nurses Registry and Harry Dorvillier for the reasons below:
- New York State Labor Law 650 et.
- William E BROCK was secretary of Labor, United States and the case was enforced under the Fair Labor Standard Act and New York.
- Only the IRS and the US Department of Labor can use the economic reality test to illustrate employee vs. independent contractor.
(1) The permanency of the working relationship; (2) The degree of skill required for the service; (3) The individual’s investment in equipment or material (4) The individual’s opportunities for profit or loss (5) The degree of control the company has over the manner in which the work performed; and (6) The degree to which the services rendered are an integral part of the company’s business
