United States Judicial Panel on Multidistrict Litigation (MDL)

IN RE: Department of Labor Enforcement  of Social Security Act – 1974

 


Enforcement:


Social Security Act – 1974 is enforcement that should be initiated by the Department of Labor. There are a number of enforcement cases in Six Circuit as well as Second Circuit that were enforced by the DOL. The Six Circuit cases are following:

LeMaster et al v. Alternative Healthcare,

Wilson v. Guardian Angel Nursing, and

Crouch v. Guardian Angel Nursing

And Second circuit case is following: Brock v. Superior Care (second circuit)

 


Misrepresentation:


In accordance with the aforementioned lawsuits, Gayle v. Harry’s Nurses Registry, Isigi v. Harry Dorvilier and Harry’s Nurses Registry, and McFarlane v. Harry’s Nurses Registry never enforce the Social Security Act – 1974 and FLSA; rather misrepresentation by the private attorney Jonathan Bernstein and the court because it never initiates according to the law.  Harry’s Nurses Registry Inc. stands to reinstate those cases by the MDL to be reviewed by the seven panels on social security enforcement, section 216 (b) matter. Multidistrict litigation is a special procedure in which federal civil cases from around the country are transferred to one court. The cases must have one or more questions of fact (issues to be determined by looking at the evidence) in common. One judge manages the litigation during the pretrial and discovery process. If a case does not settle during MDL, or is not dismissed during MDL, it is sent back to the original court for trial.
